1. Activities and Safety

1.1 Provision of Information
SunGaya verstrekt de informatie die nodig is om veilig deel te nemen aan de activiteit. Bepaalde medische en/ of psychische aandoeningen en het gebruik van bepaalde medicijnen kunnen een contra indicatie vormen voor deelname. De deelnemer is verplicht alle relevante informatie volledig en naar waarheid te verstrekken.

1.2 Medical assessment
The information provided by the participant will be reviewed by SunGaya. If this information indicates that additional medical assessment is necessary, a medical advisor may be consulted. The advisor’s decision is binding. If the requested information is not provided in time, participation may be refused. In that case, the right to participate will lapse.

1.3 Own responsibility
Participation in an activity takes place on the participant’s own initiative and at their own risk. SunGaya is not liable for situations resulting from incorrect, incomplete, or late information provided by the participant.

1.4 Contraindications and medication
The participant is required to fully and truthfully disclose all information regarding physical and mental health, medication, supplements, substance use, and relevant medical history. Certain medications and conditions may constitute a contraindication for participation. SunGaya reserves the right to refuse or postpone participation when necessary for safety reasons.

1.5 Prohibited substances in relation to the activity
The participant may not take part in the activity under the influence of alcohol, drugs, or other consciousness-altering substances, unless this has been agreed upon in writing with SunGaya in advance. This also applies to recreational use in the days leading up to the activity. In case of doubt, the participant must inform SunGaya beforehand.

1.6 Diet and preparation
The participant declares that they will follow the preparation guidelines, dietary advice, and safety instructions provided by SunGaya to the best of their ability. If the participant deviates from these guidelines, they are required to inform SunGaya prior to the start of the activity. Based on this information, SunGaya may decide to refuse or postpone participation. SunGaya is not liable for any consequences resulting from failure to follow these guidelines.

1.7 Safety within the space and following instructions
During the activity, the participant agrees to follow the instructions and guidance of SunGaya and any supporting facilitators without delay. If a participant repeatedly fails to follow instructions, crosses boundaries, or endangers their own safety or that of others, SunGaya reserves the right to terminate their participation immediately. In such cases, no refund will be granted.

1.8 Own risk and liability
The participant understands that participation may involve an intensive physical and emotional process. Participation takes place on the participant’s own initiative and at their own risk. SunGaya is not liable for any damage resulting from failure to follow the provided guidelines or from supplying incorrect or incomplete information.

2. Payment Terms

2.1 Payment Obligation
By registering for an activity, the participant commits to paying the full amount as stated on the website for the respective activity, unless otherwise agreed upon in writing.

2.2 Paymnet Term
All payments must be completed no later than 14 days prior to the start date of the activity, unless explicitly stated otherwise.

2.3 Late Payment
If payment is not made on time, SunGaya may cancel or refuse participation. After a payment reminder, the full amount must still be paid within the stated deadline. In urgent cases, the participant may contact SunGaya to discuss the situation.

2.4 No payment, no participation
Without full payment, the right to participate lapses.

3. Participation and conduct

3.1 Re-registration
For a new registration, the participant must register again via the website. This is also required if personal, medical, or other relevant information has changed.

3.2 Conduct and responsibility
The participant understands that participation takes place entirely under their own responsibility and at their own risk. The participant treats the ceremonial space, facilitators, and other participants with respect and follows SunGaya’s instructions and house rules.

3.3 Confidentiality within the group
What participants share with one another within the context of the activity is treated with respect. The participant is requested to handle personal stories and information of others confidentially.

4. Price Changes

4.1 4.1 Price changes do not affect the price of activities for which the participant has already registered and for which the full amount has been paid.
4.2 4.2 If a price increase applies to an existing reservation for which the full amount has not yet been paid, the participant must pay the difference before participation.

5. Cancellation terms

5.1 Cancellation or rescheduling
Cancellation or rescheduling is only possible via email: info@sungaya.nl. In exceptional or serious situations, SunGaya may deviate from the terms below. This is at SunGaya’s discretion. info@sungaya.nl. In uitzonderlijke of ernstige situaties kan SunGaya afwijken van onderstaande voorwaarden. Dit is ter beoordeling van SunGaya.

5.2 Refunds in case of cancellation by the participant
In case of cancellation, the following conditions apply:

A. 4 weeks or more before the activity: 100 percent of the paid amount will be refunded. B. 3 to 4 weeks before the activity: 75 percent of the paid amount will be refunded. C. 2 to 3 weeks before the activity: 50 percent of the paid amount will be refunded. D. 1 to 2 weeks before the activity: 25 percent of the paid amount will be refunded. E. Within 24 hours before the activity, on the day itself, or in case of no-show: no refund. This also applies in case of illness or force majeure on the participant’s side, unless otherwise agreed in writing.
B. 3 tot 4 weken vóór de activiteit: 75 procent van het betaalde bedrag wordt gerestitueerd.
C. 2 tot 3 weken vóór de activiteit: 50 procent van het betaalde bedrag wordt gerestitueerd.
D. 1 tot 2 weken vóór de activiteit: 25 procent van het betaalde bedrag wordt gerestitueerd.
E. Binnen 24 uur vóór de activiteit, op de dag zelf, of bij niet verschijnen: geen restitutie. Dit geldt ook bij ziekte of overmacht aan de zijde van de deelnemer, tenzij schriftelijk anders overeengekomen.

5.3 Rescheduling to a new date
If the participant requests rescheduling instead of cancellation, a new date may be offered by mutual agreement, provided this is possible in time and space is available. Administrative fees may apply.

5.4 Cancellation by SunGaya
If SunGaya must cancel the activity due to unforeseen circumstances, SunGaya is not liable for any consequential damages. The participant may, in consultation, schedule a new date or cancel. If no new date is scheduled, any amounts already paid will be refunded in full.

6. Privacy and confidentiality

6.1 Data processing (GDPR)
Personal data is processed and stored in accordance with applicable GDPR regulations.

6.2 Medical consultation
If necessary, data may be shared in anonymized form with a physician or medical advisor. This will only be done when necessary for safety reasons. Any related costs may be charged to the participant. The participant will be informed in advance.

6.3 Sharing with third parties
SunGaya does not share data with commercial parties. Data is only shared with third parties when legally required, or when necessary for safety and support, and then as limited as possible.

6.4 Retention period and newsletter
Data is not retained longer than necessary. Unsubscribing from the newsletter is possible at any time.

7. Applicable law and disputes

Dutch law applies to all agreements to which these terms and conditions apply, in whole or in part. Disputes will be submitted to the competent court in Rotterdam.
